Terms of Use

These terms of use are valid for the entire business relationship between you and HLS Berg GmbH & Co, Alte Eisenstr. 41, 57258 Freudenberg, Germany. The terms of use are therefore always valid when you use our website.

Therefore, the terms of use do not have to be agreed-upon again explicitly before the use of an individual service or the execution of an individual deal.


Liability
We assume no liability for outages, interruptions, or failures of your technical facilities or your internet provider. The same applies to damages that arise for you on account of your software or hardware working incorrectly or because your computer is infected with a virus.

We are not liable in the case of loss of data or incomplete, delayed, or otherwise incorrect transfer of data, in the case of outages, interruptions, or failures in the telephone network of the internet, our server, or other communications systems from network operators. This does not apply in the case of the breach of duties significant to the contract. The same applies to outages, interruptions, or failures in our technical systems.


Principally, we assume no liability for

- our computers and the internet pages always working without interruption and error,

- their being accessible and available at all times or that secure data transfer always occurs,

- that the information accessed from our website is complete and current at all times,

If your access data is forwarded or used without authorisation, we are only liable for thereby arising damages if you fulfil your obligations, in particular to inform us about the misuse or suspicion of misuse in a suitable way, and we have confirmed the access to this information to you.

We are not liable for damages that result from your giving us false information. In the case of damages that arise on account of access by unauthorised third parties to data of yours saved with us, we are only liable in the cases of premeditation or gross negligence.

We are not liable for damages caused by input data errors are your part.

Our liability is limited to foreseeable damages. This also applies to loss of data and other consequential damages.


Applicable Law and Agreement on Jurisdiction

German law applies. The use of the UN Convention on Contracts for the International Sale of Goods is excluded. Jurisdiction is Siegen insofar as the user is a business person, a legal entity according to public law, or has no general legal venue in the Federal Republic of Germany.

Changes

The quick development of the internet makes it necessary that we make adjustments to our terms and conditions from time to time. We will inform you of this insofar as the respective contents of your consent forms are affected.

Severability Clause

Should one or more clauses of this use agreement be invalid, incomplete, or requiring elaboration, this does not affect the validity of the other clauses. In its place or in order to close gaps in the contract, such provisions should be made that come as close as possible to the economic interests of the parties.


Conditions of Delivery

1. Price

All prices indicated in the web shop are gross prices in €/piece. They include the statutory VAT in Germany of 19% at this time. Packing and shipping costs are not included and will be calculated separately according to the volume of your order. You can gladly inquire about these with us.


2. Methods of Payment


- Direct debit, the quick way

You authorise us until revocation to charge your account with the open billing amount. You tell us your bank details (account number and bank number), and we charge your account when we send the goods. As long as you do not revoke this, all future deliveries will be settled in this way (this is only possible in the case of bank branches with domicile in Germany).

- Credit card, the modern means of payment

You give us the necessary credit card details: kind of card (e.g. VISA), number, expiry. At the time of the dispatch of the goods, we then charge your credit card with the billed amount.

At this time we accept: VISA, Mastercard, Eurocard, American Express


- Cash on delivery, the traditional way

You pay the billed amount directly upon acceptance of the goods in cash or by cheque. The COD charge (e.g. €7.50 for UPS) is included in the billed amount and will be paid by us.

- Pre-payment, the long way

After completion of the goods, we send you a bill. As soon as the billed amount has been credited to our account (this can take 3-4 days according to the bank), the delivery will be dispatched immediately.

PayPal, the secure and quick way. Convenient payment directly from your PayPal Account. Delivery takes place within the stated delivery time. In the case of delays, we notify you separately.

3. Foreign Deliveries

Deliveries to places outside of Germany occur solely in the case of payment via credit card, PayPal or pre-payment.


4. Retention of Title

In all cases, the delivered goods remain our property until complete payment.


5. Return

Should you not like our products, we will credit the purchase price if the return shipment occurs within 14 days of delivery and the goods are in new condition. In every case, the original packaging must be used for the return shipment. Upon request, a return pick up can be arranged by us by UPS. 6. Delivery

We do all that we can to process your order as quickly as possible. The item ordered by you not be available within a week, we will send you an order confirmation with the foreseen delivery time immediately. This is not a demand for payment; it is merely for your information. If you give us your order number or customer order We can give you information about the status of your order at any time.

Within Germany we prefer to ship with DPD. They deliver very reliably. Should you not be met, the driver will leave you a message and come back on the next workday. Should you not be met three times, the goods are sent back to us.


No Shipping Risk

Carriage insurance is included in our shipping costs. Should, in exceptional cases, goods arrive damaged, please inform us immediately (within 5 workdays). We will then take all necessary steps without delay so that you will quickly get flawless goods from us.

If is important that you save the packaging of the damaged delivery for awhile as evidence.

7. Complaints/Warranty

You must notify us in writing of obvious defects within one week of delivery and of hidden defects after their determination. In the case of warranted notices of defects, rectification of defects or replacement delivery will occur according to our judgement.


8. Data Protection

Your order-related and personal data is only saved by us for processing our deal with you and these addresses are not given to other companies.
